Submission of data to the Telecommunications Information Point

Information on the submission of data to the Telecommunications Information Point run by the President of UKE by network operators, road managers and heads of local administrative units - heads of communes (mayors or presidents of cities), heads of districts and voivodeships.

 

Pursuant to Article 20 (1) of the Act of 9 June 2016 on amending the act on supporting the development of telecommunications services and networks and some other acts (Journal of Laws of 2016, item 903 - hereinafter referred to as the "amending act"), information referred to in Article 29c (1) and Article 29d (1-4) and (6-7) of the Act of 7 May 2010 on supporting the development of telecommunications services and networks (i.e.  Journal of Laws of 2015, item 880, as amended - hereinafter referred to as the "Mega-law") in the wording introduced by the amending act, should be for the first time submitted by 1 October 2016.

Pursuant to the above, road managers shall submit to the President of UKE, within the term indicated above, information they possess in electronic form, concerning:
  • utility tunnels located in the right of way within their responsibility, in the scope referred to in Article 29b (1)(3) or (4) of the Mega-law;
  • in the scope referred to in Article 29b (1)(3) of the Mega-law - technology infrastructure for which the road manager issued the decision referred to in Article 39 (3) or Article 40 (1) of the Act of 21 March 1985 on public roads (i.e. Journal of Laws of 2015, item 460, as amended - hereinafter referred to as the "act on public roads").  
The obligation imposed on the heads of local administrative units - heads of communes (mayors or presidents of cities), heads of districts and voivodeships concerns information on the rates of fees for the occupation of the right of way for the purpose referred to in Article 40 (2) (1-3) of the act on public roads, established by resolution referred to in Article 40 (8) of this act.

By 1 October 2016 also the network operator - within the meaning of Article 2 (1)(8) of the Mega-law - may submit to the President of UKE information referred to in Article 29b (1)(3) or (4) of the Mega-law in order to make it available via the Telecommunications Information Point.  

The aforesaid information shall be submitted through ePUAP platform, using the following forms:
  • form for the submission of information on technical infrastructure or utility tunnel,
  • form for the submission of information on the executed or planned construction works concerning technical infrastructure or utility tunnel,
  • form for the submission of information on the rates of fees for the occupation of the right of way.
Detailed information on creating account and using ePUAP is available on the ePUAP website. The manual for searching forms is available in the attached file (in Polish only).

The person using ePUAP to submit the above-mentioned forms for the use of Telecommunications Information Point should be authorised to act on behalf of the entity which submits the data, i.e. the road manager, head of local administrative unit - head of commune (mayor or a president of city), head of district and voivodeship or network operator.  

The submitted data will be made available to telecommunications undertakings as of 1 January 2017 on the Telecommunications Information Point website.
