Opinion of the President of UKE on the reference offer of WBN

The President of UKE issued the first opinion on the charges applied by RBN (Regional Broadband Networks) operator.

 

On 30 December 2014, the President of UKE issued an opinion on the reference offer of the operator of Wielkopolska Broadband Network (WBN), concerning the access to telecommunications infrastructure built with the financial support from the EU funds. The opinion concerns the compliance of the reference offer of the WBN infrastructure operator with the provisions of the Decision of 23 May 2012, no. C(2012)3425 on state aid notification SA.33222 (2011/N) for supporting the construction of WBN; the so-called "European Commission notification decision" concerning the prices for the telecommunications access to WBN infrastructure.

In the issued opinion, the President of UKE approved the prices for the wholesale access set out by the WBN infrastructure operator and required supplementing the offer to clarify the rules applied for discounts and settlements for leasing cable ducts.

I am glad that we could have issued a positive opinion for WBN. Quick launch of services on the infrastructure built with public funds guarantees its effective use. Secondly, and most importantly, this brings us closer to the implementation of the Digital Agenda for Europe for our citizens

According to recital 56 of the EC notification decision, WBN operator shall submit its offer to the President of UKE, who approves prices set out in the offer.

The decision of the President of UKE takes into account the conditions of access to WBN specified in the EC notification decision. The main elements analysed by the President of UKE, included:

  • obligation to offer access to infrastructure exclusively within the approved areas and according to provisions defined in the EC notification decision (basing on recital 41 of the EC notification decision);
  • scope of the offered services (based on recital 47 of the EC notification decision);
  • obligation to provide broadband services to other telecommunications undertakings (based on recital 47 of the EC notification decision);
  • level of prices for the wholesale broadband access to WBN (based on recital 56 of the EC notification decision).
