New templates of reporting forms

New templates of reporting forms are valid from 1 January 2015. The old templates have been replaced with new ones to simplify and update their contents.

 

The Office of Electronic Communications informs, that as of 1 January 2015 new templates of reporting forms, as referred to in art. 7 of the Telecommunications Law, are valid. On 1 January 2015 the Ordinance of the Minister of Administration and Digitization of 10 December 2014 on the templates of forms for the submission of data on telecommunications activities (Dz. U.2014.1890) came into force, replacing the former Ordinance of the Minister of Infrastructure of 23 December 2008. The new ordinance is available at: (http://dziennikustaw.gov.pl/du/2014/1890/1).

The old templates have been replaced with new ones to simplify and update their contents. The new reporting forms are designed to facilitate their filling by entrepreneurs.

In addition, we remind that, in accordance with Art. 7 of the Telecommunications Law:

1. A telecommunications undertaking shall provide the President of UKE with information concerning the type and scope of performed telecommunications activities and the sales volume of telecommunications services in the previous financial year by 31 March.

The form of submitting the information depends on the annual revenues from performing telecommunications activities in the previous financial year:

  • A telecommunications undertaking with annual revenues from performing telecommunications activities in the previous financial year exceeding the amount of PLN 4 million shall submit to the President of UKE reports on its telecommunications activities using the reporting forms, which templates are attached to the above-mentioned Regulation.
  • A telecommunications undertaking with annual revenues from performing telecommunications activities in the previous financial year equal to or less than the amount of PLN 4 million shall submit to the President of UKE reports using the above-mentioned reporting forms or a statement containing the data specified in section 1.

2. A telecommunications undertaking with annual revenues from performing telecommunications activities in the previous financial year exceeding the amount of PLN 4 million shall also submit to the President of UKE an annual financial statement by 30 June.

F00 Reporting Forms, statements and financial statements shall be signed by person(s) authorised to represent the undertaking, as specified in the National Court Register (KRS) or the Central Registration and Information on Business (CEIDG).

If the document is signed by a representative of the undertaking, then the original or a copy of a corresponding power of attorney with confirmed stamp duty paid shall be attached to it. A copy of the power of attorney shall be certified as a true copy by a notary public or by the representative of the party, who is an advocate, solicitor, patent attorney or a tax advisor.
