How to get VSAT radio-license?

According to Ordinance of the Minister of Administration and Digitization of 12 December 2014 on radio broadcasting  devices or transceivers that can be used without a radio licence (Journal of Laws, item 1843), which came into force on 19 January 2015:

1.    The following types of satellite earth stations are determined which usage do not require the radio permission:

  • LEST type, specified in Annex No. 1
  • HEST type, specified in Annex No. 2

- the powers set out in the annexes are peak powers.

2.    If the antenna is connected with more the one transmitter or transmitter produces more than one carrier, e.i.r.p. specified in annexes must be total sum all emissions radiated by the main antenna beam.

1The frequency reception band 10,70 – 11,70 usage is connected with the risk of occurrence of the interferences from the fixed services’ devices point-to-point type (radio relays) working on the basis of the radio permissions issued.

Allowed to use devices installed only in distance more than 500 m from external fences of the airports.

 

2The frequency reception band 10,70 – 11,70 usage is connected with the risk of occurrence of the interferences from the fixed services’ devices point-to-point type (radio relays) working on the basis of the radio permissions issued.

If  the LEST or HEST devices’ parameters exceeding above presented in tables the regular radio – licence  is required.

In order to obtain the radio-licence you have to fill attached application form and send it to the Office of Electronic Communications (UKE) for proceedings.

You will have to pay the fees into indicated account and send the confirmation to the Office of Electronic Communications, Frequency Management Department, Satellite Services Division.

The whole procedure is as follow:

  • send the attached Application form for LRS signed by person authorized to represent the Company plus extract from Companies Register (copy) as a confirmation of the facts,
  • Declaration of conformity or Certificate or another document confirming compliance with electrical and EMC standards,
  • The agreement with satellite operator for usage of their satellite transponder / equipment (possibly statement that agreement is set), 
  • make a real payment on the following account and send  us as soon as possible confirmation of order of payment,

The fees:


An entity that has received the right to use a frequency subject to a general exclusive frequency licence shall pay annual fees for the right to use this frequency.

For the assignment of frequencies the fees are levied in accordance with ordinance of the council of ministers of 18 December 2013 on the annual fees for the right to use the frequency and also The Act of 16 July 2004 Telecommunications Law.

After receiving the radio licence for SNG, the Office of Electronic Communications will inform you about the Frequency fee amount.

Note: The cost of the transfer will be borne by the applicant.


Cost of using the frequency per year (*):

•    In the fixed satellite service for the right to use a frequency by one station
(Earth – Space) – PLN 12.000;
•    In the fixed satellite service for the right to use a frequency by one station
(Space – Earth) – PLN 20.000;
•    In the fixed satellite service for the right to use a frequency by one station
(Space – Earth and Earth – Space) – PLN 20.000 (**).


(*) simplified method to calculate the fee for one day, divide the amount of the annual fee by the number of days in a year (the exact amount of the fee frequency will be sent within two weeks from the date of receipt of radio licence).
(**) fees in fixed satellite service for the right to use a frequency by one station may not be higher than – PLN 20.000  (Article 185 paragraph 5 The Act of 16 July 2004 Telecommunications Law)
