The President of the Office of Electronic Communications launched proceedings against Tele2 Polska sp. z o.o. for breaching information obligations towards end users when concluding contracts for the provision of telecommunications services.
According to the President of UKE, it may be reasonably presumed that Tele2 Polska Sp. z o.o. (Tele2) was misleading subscribers/end users bringing them to make unintended declarations of will while concluding contracts, in particular away from business premises and at distance by means of distance communication. This was done by giving ambiguous and vague information regarding the manner in which the contracts were concluded and applying procedures for the conclusion of contracts that were incomprehensible to an average user.
Numerous complaints received by the President of UKE have indicated that an operator neglects consumer rights to obtain full and reliable information when concluding distance contracts or away from business premises, as well as hinders termination of contracts and shows negligence in considering complaints and in settlements for provided services.
